Jane F. Collen
Primary Areas of Practice
Overview
Jane Collen has more than thirty years’ experience counseling clients across a wide range of intellectual property matters, focusing on the adoption, protection, and enforcement of trademark rights. At Rothwell Figg, she provides high-level strategic guidance and counsel to clients. An adjunct to the day-to-day legal work, Jane focuses her role on continuity, client service, and above all, acting as the high-level voice of clients as well as serving as their strategic advisor.
Prior to joining Rothwell Figg, Jane co-founded Collen IP, one of the top firms in the country in terms of the volume of administrative litigation before the U.S. Patent and Trademark Office (USPTO). Based in New York, the firm provided clients with the full spectrum of IP-related services, with a special emphasis on trademark issues, from the initial trademark application process to litigation and other proceedings in defense of contested trademarks. As with all trademark work, Jane’s practice has a major international dimension, including a global network of associated law firms and companies for whom she has obtained registrations on behalf of clients in over 150 jurisdictions worldwide. In addition to serving U.S.-based companies, Jane also works with numerous foreign-based companies seeking to protect their IP in the United States.
While with Collen IP, Jane built a reputation as an authority, thought leader, and educator in intellectual property topics, particularly as the author of dozens of articles for scholarly and academic publications, and as the founder of a networking organization for women in business. She and her partner Jess Collen played a role in shaping the development of IP law in respect to the Internet. They delivered talks on Internet-related IP issues before many of her colleagues even understood what the Internet was. Currently Jane provides CLE accredited lectures on the Copyright and Trademark issues inherent in the plethora of FanFiction and fan websites.
As a senior practitioner, a recognized leader in the field, and now, of counsel to Rothwell Figg, Jane has assumed the role of a high-level strategic advisor to clients. Given the highly factual and technical nature of intellectual property, and the complexity of the global trademark practice in which Jane specializes, it’s easy, and not uncommon, for attorneys and their clients to lose sight of the forest due to the trees. Jane’s role is asking the bigger tactical questions, and working with clients to ensure we focus on addressing and developing the right IP strategies and protection for them. This includes helping clients consider, and if possible, anticipate, policy issues and changes that will affect their businesses directly. Above all, her interpersonal communications skills ensure that Rothwell Figg provides each client with the best possible representation and counsel for their specific needs.
