The article explains that before the Federal Trade Commission's (FTC) policy statement on the collection of biometric information, potential litigation surrounding biometric data was mostly of concern in Illinois due to the state's 2008 Biometric Information Privacy Act (BIPA), and while other states and cities have followed in enacting biometric legislation, Illinois' law permits a private right of action and therefore remains the most strict. The article also explains that the FTC's statement last month notes that it plans to follow closely the collection and use of biometric information, as it may violate section 5 of the Federal Trade Commission Act. The FTC is concerned not only about consumer privacy and data, but also that the uptick in using the information could lead to potential bias and discrimination.
"The first step is to 'see if you really need' the biometric data and, if so, be sure any statements made 'are absolutely true,'" Jenny told Business Insurance.
