Partners Steven Lieberman and Jenny Colgate will participate in a session titled "Patent disputes and litigation: strategies for optimising success," at the 2019 Managing Intellectual Property (MIP) US Patent Forum to be held April 3-4, 2019, in New York, New York.
Steven will act as moderator and Jenny as a panelist in a discussion covering:
- How application of the Phillips standard at the PTAB will affect district court litigations, including timing/utility of claim construction hearings, stays, and deference to the PTAB’s claim constructions
- Damages strategies in light of Western Geco; Daubert strategies
- Portfolio licensing issues, including portfolio valuation, monetization strategies, patent stacking, the changing nature of PAEs
- Changes in litigation following TC Heartland, including where cases are filed, what cases are filed, and transfer motions
