Brian A.Tollefson has far-reaching experience in all aspects of patent, copyright, trade secret, and related intellectual property matters including acquisition, exploitation, monetization, enforcement, and defense. 

Highlights include:

  • Fifteen plus years litigation experience involving over 25 patent infringement litigations in Federal District Courts representing both plaintiffs and defendants, responsible for directing the litigations on a day-to-day basis, but also working at every level including first chair.
  • Fifteen plus years preparation and prosecution of U.S. and international patent applications.
  • Fifteen plus years conducting U.S. PTO proceedings, such as AIA Post Grant Review, Inter Partes Review and Covered Business Method Patent Review proceedings, reissue and reexamination proceedings, appeals, examiner interviews and petitions to the Director.
  • Significant Mediation and ADR experience.
  • E-discovery and forensic sciences.
  • Patent portfolio mapping, development, auditing, valuation, and acquisition.
  • Transactional matters involving licensing, joint ventures, mergers, development and consulting agreements, including negotiation, drafting, and enforcement.
  • Opinion matters including essentiality, due diligence, validity, and infringement
  • Local counsel experience in the District of Maryland.
  • Conversant in a broad range of technologies and fields, including finance, electronic trading, computer software and hardware, business methods, telecommunications, internet and e-commerce, semiconductor, process controls, automotive and engine design.

Prior to law school, Mr. Tollefson worked for nearly a decade in private industry as a software engineer and project manager. He has extensive industry experience in planning, scheduling and managing large multi-million dollar replacement projects; enterprise software implementation and lifecycle design; software and database designs; programming; outage management; instruments and controls; radiation control; and nuclear operations and compliance.
